Manifestation Determination is the process which is required by the Individuals with Disabilities Education Act (IDEA 2004), used in determining when a student with special needs portrays inappropriate behavior. It is used to determine if this behavior is related to their disability or not. This process is a review hearing that must be conducted before a student can be expelled or suspended for more than ten days. It is a meeting that must be held to determine if the student's behavior is related to their disability. The student's IEP team makes the manifestation determination. They do this by reviewing the student's disability, the services the student receives, and the inappropriate behavior (Smith, 2016). The team decides if the behavior was due to inappropriate placement, or whether the IEP isn't being executed properly, or if the disability is the reason for the behavior (Smith, 2016). If the first three findings are the reasons for the inappropriate behavior then the student cannot be suspended or expelled. If the IEP team determines that the behavior is not because of the disability then the student can be disciplined comparable to any other student.
